Conditions and rules
1. General Provisions.
These Terms and Conditions of Sale and Purchase ("Terms and Conditions") are a legally binding document which sets out the rights, obligations and responsibilities between the Buyer ("You") and the Seller ("We") in relation to the purchase of goods from the Le Kuku e-shop ("e-shop").
2. The moment of conclusion of the contract of sale and purchase.
2.1 The contract between You and Us shall be deemed to have been concluded from the moment You click on the "Order" button in the e-shop, after having created a shopping cart, indicated the delivery address, chosen the payment method and read Our Terms and Conditions.
2.2 The Contract shall commence when We receive Your payment for the Goods within 3 (three) working days and shall remain in force until the Goods have been fully delivered.
2.3 Every contract concluded between Us and You is stored in the e-shop.
2.4 The order sent and printed by e-mail shall constitute a preliminary invoice against which payment is made.
3. Your rights:
3.1 You have the right to purchase goods in the e-shop in accordance with these terms and conditions and the e-shop.
3.2 You have the right to withdraw from the contract for the sale of goods with the e-shop, unless the contract is concluded as a result of:
3.2.1. participation in games or lotteries;
3.2.2. in other cases where the contract of sale and purchase cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.
4. You undertake to:
4.1. you must pay for the goods within 3 (three) working days of placing the order, and accept them unless otherwise agreed.
4.2 If the details provided on your registration form change, you must update them immediately.
4.3 By using the e-shop, you agree to these Terms and Conditions of Sale and Purchase and must comply with them.
5. Our Rights:
5.1 If the Buyer attempts to interfere with the operation or stable functioning of the e-shop, We may, without prior notice, restrict or suspend the Buyer's access to the e-shop or, in exceptional cases, cancel the Buyer's registration.
5.2 We may, in important circumstances, temporarily or permanently suspend the operation of the e-shop without prior notice to You.
5.3 We may unilaterally change the terms and conditions of these Terms.
6. We undertake:
6.1. to provide you with all the conditions for the proper use of the e-shop services.
6.2 Deliver the goods you have ordered to the address you have specified and within the agreed delivery period.
6.3 In the event of important circumstances where we are unable to deliver the goods you have ordered, we undertake to offer you an equivalent product and, in the event that you refuse to accept an equivalent product, to refund your money within 72 hours.
7. Delivery:
7.1 The Goods shall be delivered by Us or Our authorised representative.
7.2 At the time of delivery of the Goods, You must inspect the condition of the consignment with Us or Our authorised representative.
7.3 Once You have signed the Invoice or the delivery document, the Consignment shall be deemed to have been delivered.
7.4 If You notice any damage to the Consignment, You must not accept the Consignment and You must note this on the Consignment Note. If you accept the goods and sign the consignment note without remark, the consignment shall be deemed to have been delivered in good order.
8. Returning items.
8.1 Returns shall be made in accordance with the terms of the Return Policy dated 29 June 2001. Order No 217 of the Minister of Economy of the Republic of Lithuania "Approval of the Rules for the Return and Exchange of Items".
8.2 The returned item must be fully assembled. You are responsible for the complete assembly and packing of the item. If the item is not complete and properly packed, We or Our representative will not accept the item for return.
8.3 The item must be returned in the packaging in which it was delivered. The packaging must be undamaged, clean, properly prepared and packed.
8.4 The cost of returning the goods shall be borne by you, unless the goods are returned because of poor quality.
8.5 Where Goods are returned in poor quality, We undertake to collect the poor quality Goods and replace them with similar Goods. In the event that We do not have an equivalent product, We will refund the money paid by You for the product.
9. Liability.
9.1 You are solely responsible for the accuracy of the information provided on the registration form. If You do not provide accurate details on the registration form, We shall not be liable for any consequences arising therefrom.
9.2 You are responsible for the actions you take when using the e-shop.
9.3 You are responsible for the transmission of the identification code to third parties. If third parties use your identification code, you are responsible for the actions performed by the third party.
10. Transmission of information.
10.1 We will send all communications to the email address provided in your registration form.
10.2 You shall send all communications and questions to Us by the means indicated in the "Contact Us" section of Our e-shop.
11. Protection of personal data.
11.1 Any information relating to personal data shall be subject to the Seller's personal data protection policy, which shall be governed by the relevant Laws of the Republic of Lithuania and shall be implemented in accordance with the recommendations of the State Data Protection Inspectorate.
11.2 The Seller shall not transfer (except in accordance with the procedure established by the Laws of the Republic of Lithuania) the Buyer's personal data to third parties other than persons contributing to the execution of the order, for whom such data is necessary for the successful execution of the order (e.g. postal couriers).
12. Final provisions.
12.1 The dissemination of any information from the e-shop without the written consent of the Seller is prohibited.
12.2 These Terms and Conditions are governed by the law of the Republic of Lithuania.
12.3 All disagreements arising from the execution of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
